FMLA compliance
The Family and Medical Leave Act gives eligible employees job-protected leave. We help you track eligibility, send the right notices and coordinate FMLA with Colorado's paid leave.

Job-protected leave, tracked correctly from the first notice to the return.
Who does FMLA cover?
FMLA applies to private employers with 50 or more employees for 20 or more weeks in the current or prior year. Eligible employees (12 months of service, 1,250 hours in the past year, at a worksite with 50 employees within 75 miles) can take up to 12 weeks of unpaid, job-protected leave a year, or 26 weeks to care for a servicemember, with group health coverage continued.

Is FMLA leave paid?
No, FMLA leave is unpaid, though employees may use accrued paid leave. In Colorado, FAMLI can provide wage replacement during the same absence.
Can FMLA and Colorado FAMLI run at the same time?
Yes. When leave qualifies under both, they can run concurrently, so the employee doesn't automatically get both back to back.
Do we have to keep paying for health insurance during FMLA leave?
Yes. You must maintain group health coverage on the same terms as if the employee were working, including your share of the premium.
